Cubiq Infotech POS SaaS – Registration Terms & Conditions

Welcome to Cubiq Infotech POS SaaS (“Platform”, “Service”, or “CubiqPOS”), operated by Cubiq Infotech Pvt. Ltd., a company incorporated under the Companies Act, 2013, and having its registered office in Gujarat, India (“Company”, “we”, “our”, or “us”).

By registering, accessing, or using our services, you (“User”, “you”, or “your”) agree to be bound by the following Terms and Conditions. If you do not agree, please do not register or use our Service.

1. Eligibility

By registering on CubiqPOS, you confirm that:

• You are at least 18 years old and capable of entering into a legally binding agreement under Indian law.

• You are registering on behalf of yourself or a legally recognized business entity.

• All information provided during registration is true, accurate, and complete.

2. Account Registration

• To use CubiqPOS, you must create an account by providing valid details such as your name, email address, contact number, business information, and payment method (if applicable).

• You are responsible for maintaining the confidentiality of your account credentials.

• You must immediately notify Cubiq Infotech of any unauthorized access or use of your account.

• Cubiq Infotech reserves the right to suspend or terminate accounts that contain false, incomplete, or misleading information.

3. Subscription and Payment

• Certain features or modules of CubiqPOS may require a paid subscription.

• You agree to pay all applicable fees as per the pricing plan selected at the time of registration.

• Payments once made are non-refundable, except as required by applicable Indian law or as specified in a separate written agreement.

• Cubiq Infotech reserves the right to modify pricing or subscription terms with prior notice.

4. Use of Service

You agree to use the Service only for lawful business purposes. You must not:

• Engage in activities that violate any Indian law or regulation.

• Attempt to copy, modify, decompile, or reverse-engineer any part of the CubiqPOS software.

• Use the Service to distribute malicious software, fraudulent content, or unauthorized data.

• Share login credentials or provide access to unauthorized third parties.

Cubiq Infotech reserves the right to monitor system usage and take appropriate action, including suspension or termination, for misuse or violations.

5. Data Privacy

Cubiq Infotech is committed to protecting your data in compliance with the Information Technology Act, 2000 and applicable data protection laws in India.
By registering, you consent to the collection, storage, and processing of your personal and business data as described in our Privacy Policy.

6. Intellectual Property

All software, trademarks, logos, content, and materials available on CubiqPOS are the exclusive property of Cubiq Infotech Pvt. Ltd. or its licensors.
You are granted a limited, non-transferable, and non-exclusive license to use the Service solely for your internal business operations.

7. Termination

Cubiq Infotech reserves the right to suspend or terminate your account at its sole discretion if:

• You violate these Terms or applicable laws.

• You fail to make due payments.

• Misuse or abuse of the Service is detected.

You may cancel your account at any time by contacting Cubiq Infotech Support. Upon termination, your access to the platform will cease, but any outstanding payment obligations will remain due.

8. Limitation of Liability

To the maximum extent permitted under Indian law:

• Cubiq Infotech shall not be liable for any indirect, incidental, special, or consequential losses, including loss of profits, business interruption, or data loss.

• The total liability of Cubiq Infotech, for any claim arising from your use of the Service, shall not exceed the amount paid by you to Cubiq Infotech in the preceding 12 months.

9. Modification of Terms

Cubiq Infotech reserves the right to modify or update these Terms & Conditions at any time. Updated terms will be effective upon posting on our website or platform. Continued use of the Service after such updates constitutes your acceptance.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.
